The short of it is no, oats are not part of the gluten family. However, not all oats are labelled as "gluten free" because they are usually processed in plants that work with a lot of grains that are in the gluten family. Because of dust they are considered cross-contaminated and therefore are not labelled as gluten free.
Yes! With the exception of the S'mores flavor, all other flavors are gluten free.
